Indiana Passes HB 1621, Reducing Lien-Sale Waiting Period for Self-Storage Operators
Indiana Governor Eric Holcomb signed House Bill 1621 (HB 1621) into law on April 20, modifying the timeline for self-storage operators to initiate the lien-sale process. The bill, which takes effect on July 1, reduces the waiting period for operators to deny access to delinquent tenants and sell unit contents.
Key Points:
Reduced Waiting Periods
Operators can restrict access to units after 5 days of delinquency (previously 30 days). Operators can sell unit contents after 60 days of default (reduced from 90 days).
Alternate Contact Designation
Tenants can designate a backup contact to receive late-payment notifications. Alternate contacts can receive communication but don’t have access to stored property unless explicitly authorized in the lease.
Industry Support
The Indiana Self Storage Association supported the measure, citing that Indiana’s previous lien-processing timelines were out of step with similar laws in other states.
Legislative Approval
Passed the House on Feb. 14 with a 62-27. Passed the Senate on March 21 with a 40-2.
